PERMITS FOR NON-EU CITIZENS

Non-Lucrative Visa

Also known as passive income Visa.

Residence authorization, without work permit.

Only authorizes to reside in Spain without performing economic  activities.

To have the necessary economic means to cover the expenses of stay and return and, where appropriate, those of their family members, in accordance with the following amounts:

For their monthly support 400% of the IPREM (2,400 €/month)

For the support of each of their family members, 100% of the IPREM: 600 €/month.

To have a public or private health insurance arranged with an insurance company authorized to operate in Spain.

– Not to be a citizen of a State of the European Union, the European Economic Area or Switzerland, or a family member of citizens of these countries to which the Union citizen regime applies.

– Not to be irregularly in Spanish territory.

– Not to have a criminal record in Spain and in their previous countries of residence for crimes existing in the Spanish system.

– Not to be forbidden to enter Spain and not to appear as rejectable in the territorial space of countries with which Spain has signed an agreement in such sense.

– Not to suffer from any of the diseases that may have serious public health repercussions in accordance with the provisions of the International Health Regulations of 2005.

– Not being, if applicable, within the period of commitment not to return to Spain that the foreigner has assumed when applying for a voluntary return program.

VISA APPLICATION PROCEDURE

Place of submission: Spanish diplomatic mission or consular office in whose demarcation the applicant resides.

Resolution period: The term for notification of the resolution is three months counted from the day following the date on which it was received at the registry of the competent body for its processing.

Once the visa has been collected, the applicant must enter Spain within the period of validity of the visa, which in no case will be longer than three months.

Term: The initial authorization of temporary residence will have the duration of one year and the validity will begin on the date of entry into Spain.

FOREIGNER’S IDENTITY CARD INFORMATION

Within one month of entry into Spain, the foreigner must apply in person for the foreigner’s identity card (“TIE”) at the Immigration Office or Police Station in the province where the authorization has been processed.

EU Family member

Family members of a Spanish citizen or of another European Union Member State, or of another State party to the Agreement on the European Economic Area or Switzerland, who do not hold the nationality of one of said States, and are going to reside in Spain for a period of more than three months.

Accompany or join a citizen of the EU or another State part of the European Economic Area, with the right of residence for a period of more than three months.

The citizen of the EU or another State part of the European Economic Area, must fulfill one of the following conditions:

– To be an employee in Spain, or

– Be self-employed in Spain, or

Have sufficient economic resources for themselves and their family members.

In this case, they must also provide public or private health insurance, contracted in Spain or in another country, which provides coverage in Spain during their period of residence equivalent to that provided by the National Health System; or

Be a student and be enrolled in a public or private center recognized or financed by the educational administration for studies or vocational training.

Having public or private health insurance contracted in Spain or another country that provides full coverage in Spain, and responsible declaration that he/she has sufficient economic resources for him/herself and the members of his/her family so as not to become a burden on the social assistance of Spain during his/her period of residence.

Place of submission: Immigration Office of the province where the applicant intends to reside or at the corresponding Police Station. 

Deadline for submission: three months from the date of entry into Spain. A receipt certifying the presentation of the application will be issued, which is sufficient to certify the legal stay until the card is issued.

Resolution period: The residence card must be issued within three months after the application is filed. The favorable resolution takes effect from the accredited date of entry into Spain as a family member of a citizen of the Union.

Validity of the residence card: the card will be valid for five years from the date of issue, or from the foreseen period of residence of the Union citizen, if this period is less than five years.

Business activity

Temporary residence and work authorization for a non-resident foreigner in Spain to carry out a lucrative self-employed activity.

– Not to be a citizen of a State of the European Union, the European Economic Area or Switzerland, or a family member of citizens of these countries to which the Union citizen regime applies.

– Not to be irregularly in Spanish territory.

– Not to have a criminal record in Spain and in their previous countries of residence for crimes existing in the Spanish system.

– Not to be forbidden to enter Spain and not to appear as rejectable in the territorial space of countries with which Spain has signed an agreement in such sense.

– Not to suffer from any of the diseases that may have serious public health repercussions in accordance with the provisions of the International Health Regulations of 2005.

– Not to be, if applicable, within the period of commitment not to return to Spain that the foreigner has assumed when taking part in a voluntary return program.

– To fulfill the requirements that the  legislation demands for the opening and operation of the projected activity.

– To have the required professional qualification or accredited experience, sufficient in the exercise of the professional activity, as well as, if applicable, membership in a professional association when so required.

– To be able to prove that the planned investment is sufficient and the impact, if any, on job creation.

– To be able to prove that it has sufficient economic resources for its maintenance and accommodation, after deducting those necessary for the maintenance of the activity.

PERMIT APPLICATION PROCEDURE Place of submission: Spanish diplomatic mission or consular office corresponding to the place of residence. Resolution period: Three months from the day following the date on which it was received at the registry of the competent body for its processing. The diplomatic mission or consular office will notify the interested party of the resolution on the application for temporary residence and self-employment. VISA APPLICATION PROCEDURE In the case of granting the permit, the applicant has one month from the notification to apply personally for the visa, in the diplomatic mission or consular office in whose demarcation he/she resides. Resolution period: The diplomatic mission will decide on the application within one month. Once the visa has been collected, the applicant must enter Spanish territory within the period of validity of the visa, which will be three months. SOCIAL SECURITY AFFILIATION From the date of entry into Spain, the foreigner has three months to be register at the Social Security system, and subsequently pay contributions in accordance with the terms established by the applicable Social Security regulations. FOREIGNER’S IDENTITY CARD INFORMATION Within one month of registering at the Social Security, the foreigner must apply in person for the foreigner’s identity card (“TIE”) at the Immigration Office or Police Station in the province where the authorization has been processed. 

Student Visa

Authorization to stay in Spain for a period of more than ninety days for the completion or extension of studies in an authorized educational center in Spain, in a full-time program, leading to the award of a degree or certificate of studies.

Not to be a citizen of a State of the European Union, the European Economic Area or Switzerland, or a relative of citizens of these countries to which the regime of citizens of the Union is applicable.

Not to be prohibited to enter Spain and not to appear as rejectable in the territorial space of countries with which Spain has signed an agreement in such sense.

– Have sufficient financial means to cover the costs of stay and return to their country and, where appropriate, those of their family members, in accordance with the following amounts:

For their support, 100% of the IPREM. (IMPREM 2023: 600 €/month) unless it is duly accredited to have paid in advance the accommodation for the entire duration of the stay.

For the support of their family members, monthly, 75% of the IPREM for the first family member and 50% of the IPREM for each of the remaining persons, unless they can duly prove that they have paid in advance for accommodation for the entire duration of the stay.

– To have a public or private health insurance arranged with an insurance company authorized to operate in Spain.

– To have been admitted to an authorized educational center in Spain, for the completion of a full-time program, leading to the award of a degree or certificate of studies.

– In the case of underage students who are not accompanied by their parents or guardians, authorization from them, with proof of the center, organization, entity, and body responsible for the activity and the planned period of stay.

In case that the duration of the stay exceeds six months, it will be required:

– In the case of adults of criminal age, not to have a criminal record in Spain and in their previous countries of residence during the last five years for offenses existing in the Spanish system.

Not to suffer from any of the diseases that may have serious public health repercussions in accordance with the provisions of the International Health Regulations of 2005.

VISA APPLICATION PROCEDURE

Place of submission: Spanish diplomatic mission or consular office in whose demarcation the foreigner resides.

From Spain: Through the Mercurio Iniciales Immigration platform or by appointment at the Immigration Office of the province where the school is located. 

Resolution period: the maximum period for notifying the resolution is one month from the day following the date of presentation of the application at the consular office responsible for processing it.

Term: The duration of the stay granted will be equal to the duration of the studies to be carried out, with a maximum limit of one year (or two years in the case of studies carried out in an authorized institution of higher education, leading to a recognized higher education degree).

FOREIGNER’S IDENTITY CARD INFORMATION

In the event that the stay for studies has a duration of more than six months, the foreigner must apply, in person, for the Foreigner’s Identity Card at the Immigration Office or Police Station of the province where the authorization has been processed.

GOLDEN VISA

Investors

For those who make a significant investment in Spain.

A foreigner over 18 years of age who has made a significant investment in Spain may apply for authorization of residence as an investor if the investment meets the minimum amounts required:

– Investment in financial assets:
* Public Debt – €2 million;
* Shares or equity investments in companies with Spanish capital – €1 million;
Investment funds, closed-end investment funds or venture capital funds incorporated in Spain – €1 million;
* Bank deposits in Spanish financial institutions – €1 million.

– Investment in real estate – €500,000. MORE INFORMATION

– Investment in a business project in Spain: there is no minimum amount for this type of investment, its impact on the general interest is assessed:
* Creation of jobs.
* Socioeconomic impact on the geographical area where it will be developed.
* Relevant contribution to scientific and/or technological innovation.

Entrepreneurs

For those that will develop a project of innovative nature and with special economic interest for Spain.

Foreign citizens over 18 years of age who intend to develop an entrepreneurial and business activity of an innovative nature that is of special economic interest for Spain.

There are two options:

– A visa, for those who, being abroad, need to come to Spain to carry out the necessary procedures to start up the entrepreneurial activity.

– An authorization, for those who are in Spain and wish to start their project.

There are no minimum investment or job creation requirements.

An individual analysis of each project is always carried out, and a business plan of the project must be provided in order to assess its economic interest for Spain.

Highly Qualified Professionals

For those foreign professionals with a job offer for a management position.

Foreign professionals with a job offer in Spain for the development of an employment or professional relationship in a management position or activity for which a higher education qualification is required or, exceptionally, a minimum of three years of professional experience that can be considered equivalent to such qualification, related to the activity for the performance of which the authorization is granted, is accredited.

PERMITS FOR EU CITIZENS

EU Certificate

Any EU citizen that wishes to reside more than 3 months in Spain, has to register in Spain and obtain an EU certificate.

– Being employed in Spain, or

– Being self-employed in Spain, or

– Having sufficient economic resources for the main applicant and the family members along with public or private health insurance, or

Student enrolled in a public or private center recognized or financed by the educational administration for studies or vocational training.

Place of submission: Immigration Office of the province where he/she intends to reside or at the corresponding Police Station. 

Deadline for submission: three months from the date of entry into Spain.

Issuance of the certificate of registration: once the fee has been paid, upon verification of the requirements, a certificate of registration will be issued immediately to the applicant, stating the name, nationality, address, applicant’s identity number and date of registration.

Citizenship by residence in Spain

One of the ways of obtaining the nationality is by residence, which requires the residence of the person in Spain for ten years in a legal, continuous and continuous manner immediately prior to the petition.

There are cases in which the required period of residence is reduced; these are:

– Five years: for persons who have obtained refugee status.

– Two years: for nationals of Latin American countries, Andorra, the Philippines, Equatorial Guinea, Portugal or persons of Sephardic origin.

– One year:
-For those born in Spanish territory.
– Those who who did not duly exercise his right to acquire the Spanish nationality by option.
– Those who have been legally subject to the guardianship (under the supervision of a guardian), guardianship or foster care (the foster care that allows the reduction of legal residence to one year is the one in which there is a resolution of the public entity that has in each territory entrusted the protection of minors and the foster care that are judicially recognized) of a Spanish citizen or institution for two consecutive years, even if it continues in this situation at the time of the application.
– Those that at the time of the application, have been married to a Spanish citizen for one year and is not legally or de facto separated.
– The widow or widower of a Spaniard, if at the moment of the death of the spouse they were not separated, in fact or judicially.
– Born outside Spain of father or mother, (born also outside Spain), grandfather or grandmother, as long as all of them had been originally Spanish.

In addition, the interested party must accredit good civic conduct, and sufficient degree of integration in the Spanish society.
