Case Study: Renewal of a Non-Lucrative Residence Permit in Spain 🪪✔️

In this case study, we explain how we handled the renewal of a non-lucrative residence permit for a client who contacted our firm only a few days before their permit was set to expire. The renewal had to be processed under the new Immigration Regulation (Royal Decree 1155/2024, of 19 November), which introduces significant changes to the financial requirements and supporting documentation.

Our goal was to renew the non-lucrative residence permit on time, avoid sanctions, and ensure that the client maintained continuous legal residence in Spain without interruption.

Client’s Situation Before Starting the Renewal 🤔

The client reached out to Luxton Legal five days before the expiration date of their residence card. Only three working days remained to file the application, making it a highly urgent and complex case.

Despite the tight deadline, the client met the two essential requirements for the non-lucrative renewal:

  • Sufficient financial means.
  • Valid private health insurance in Spain.

The client was also unaware of the legal deadlines:

  • The renewal can be filed during the 60 days prior to expiry.
  • Or within the 90 days after expiry, although this can trigger a sanctioning procedure.

After reviewing the documentation immediately, we were able to start the process on time.

Key Changes Introduced by the New Immigration Regulation 💥

With the entry into force of Royal Decree 1155/2024 (applicable from May 2025), the renewal of the non-lucrative permit requires clearer and more robust proof of:

  • Stable and demonstrable financial means.
  • Health insurance with no co-payments.
  • Continuity in meeting the initial conditions of the permit.

A well-prepared application is now essential to avoid delays or additional requests for documentation.

👉 How We Prepared the Renewal Application

In just a few days, Luxton Legal:

  1. Analysed the client’s financial documentation.
We reviewed bank statements, minimum balances, and consistency of income.
  2. Verified private health insurance
We ensured the policy complied with all legal requirements.
  3. Prepared all official forms and supporting statements
Adapted to the new regulatory criteria and aligned with the expectations of the relevant Immigration Office.
  4. Submitted the renewal electronically
Ensuring the application was filed within the deadline and avoiding the need for the client to travel.

Thanks to this process, the application was correctly registered and the client maintained legal residence throughout the entire procedure.

Outcome of the Case 👏🏻

The non-lucrative residence renewal was successfully submitted on time, avoiding:

  • Sanction procedures.
  • Loss of continuity of residence.
  • Risk of refusal due to late submission.

With our assistance, the client was able to renew their non-lucrative residence permit without travelling and with full legal security.
