El programa Golden Visa o residencia por inversión surge desde la aprobación de la Ley 14/2013, de apoyo a los emprendedores y a la Internacionalización.
A partir de entonces, los extranjeros pueden solicitar la residencia en España a través de inversiones inmobiliarias.
Además, la autorización de residencia otorga derecho a residir y trabajar en España inicialmente durante 1 año*, así como a viajar por el espacio Schengen.
La duración del visado puede ampliarse hasta 5 años, tras los cuales se puede obtener un permiso de residencia permanente.
* Si la aplicación inicial se realiza desde territorio español, se otorgará un permiso de 3 años, de lo contrario sería 1 año.
** Se puede solicitar el visado antes de invertir la totalidad del importe requerido. En este caso, la duración del permiso será de 6 meses, debiendo acreditarse posteriormente que se ha realizado la totalidad de la inversión.
¿Cómo solicitar la Golden Visa?
En primer lugar, es importante que te asegures que cumplas con los siguientes requisitos:
– No ser ciudadano de la Unión Europea, del Espacio Económico Europeo o de Suiza, o familiar de ciudadanos de estos países.
– También debes ser mayor de edad (18 años).
– No haber entrado en España ilegalmente, ni haber permanecido ilegalmente o tener prohibida la entrada en alguno de los países Schengen.
– Deberás contar con un seguro médico público o privado con una compañía de seguros autorizada para operar en España. Es importante saber que un seguro de viaje no será válido.
– Carecer de antecedentes penales en los últimos 5 años.
– Por otro lado, deberás acreditar la adquisición de un inmueble en España con una inversión de valor igual o superior a 500.000 €. El inmueble debe estar libre de cargas o gravámenes sobre esos 500.000 € iniciales.
– Finalmente, deberás disponer de recursos económicos suficientes durante tu periodo de residencia en España. Es decir, deberás acreditar como mínimo una cantidad equivalente a 2.800 € mensuales para tu sostenimiento. Además, en caso de tener familiares a cargo, habrá que añadir 700 € para cada uno de ellos.
Beneficios de la Golden Visa?.-
A diferencia de otros visados, con la Golden Visa no hay obligación de pasar un tiempo mínimo en España. Por lo general, podrás mantener tu residencia fiscal fuera de España, y del mismo modo beneficiarte de tener residencia en España. También tendrás la libertad de viajar y permanecer de forma ilimitada en la UE (Schengen).
La Golden Visa te permite comprar y vender inmuebles durante el periodo de residencia, siempre que se mantenga el umbral de inversión.
Conviene destacar que también los cónyuges, las parejas de hecho, los ascendientes y los hijos a cargo (independientemente de la edad) obtendrán permisos de residencia temporal.
La Golden Visa es un permiso privilegiado y rápido.
La resolución de la solicitud suele tardar entre 10 y 30 días hábiles, siendo así más rápido que otros permisos de residencia.
Preguntas frecuentes sobre el programa Golden Visa.-
– ¿Puede ser una empresa la que adquiera el inmueble?
Sí, la adquisición del inmueble puede ser realizada por un individuo (persona física) o a través de una persona jurídica (empresa).
En caso de que sea una empresa, debes cumplir con lo siguiente:
– No estar domiciliado en un paraíso fiscal.
– Tener una participación mayoritaria en la empresa, así como la facultad de nombrar o destituir a sus directivos.
– Presentar un informe de la DGCOMINVER acreditando los puntos anteriores.
– ¿Cuánto tarda el proceso de solicitud de la visa gold?
El procedimiento de solicitud de la Golden Visa puede dividirse en dos etapas:
1. La adquisición del inmueble puede durar aproximadamente 6 semanas (40-50 días laborables). En última instancia, dependerá de factores externos como las agencias inmobiliarias (si las hay), el vendedor del inmueble y la colaboración del cliente.
2. El proceso de solicitud del permiso de residencia tarda un máximo de 20 días.
– ¿Puedo invertir en varias propiedades?
Puedes invertir en cuantas propiedades quieras. Como mencionábamos, el principal requisito para solicitar la Golden Visa o residencia por inversión es que se inviertan 500.000 € así sea en uno o varios inmuebles.
– ¿Hay algún límite temporal para realizar la inversión?
Actualmente no hay ningún límite para realizar la inversión. Es decir, puedes comprar varios inmuebles a lo largo de los años. Sin embargo, no podrás solicitar la Golden Visa hasta que el importe invertido no llegue a 500.000€.
– ¿Puedo financiar parte de la inversión?
Sí, puedes financiar la parte de la inversión que sobrepase los 500.000 € iniciales.
Por ejemplo, si el inmueble que te interesa cuesta 700.000 € puedes financiar 200.000 € (ya que los 500.000 € iniciales son el importe mínimo de inversión en este tipo de visado.)
– ¿Con la Golden Visa España puedo solicitar pasaporte español?
El programa Golden Visa no te concede pasaporte español automáticamente, pero te permite residir legalmente en España. Transcurrido un periodo de 10 años y cumpliendo otros requisitos, podrás solicitar la nacionalidad, lo que permite la expedición de un pasaporte español.
Por otro lado, en caso de nacionales de países iberoamericanos, Andorra, Filipinas, Guinea Ecuatorial, o Portugal, el plazo para solicitar nacionalidad es de 2 años.

The Golden Visa scheme or residence by investment arises from the approval of Law 14/2013, to support entrepreneurs and internationalization.
Since then, foreigners can apply for residency in Spain through Real Estate investments.
Moreover, the residency permit grants the right to reside and work in Spain initially for a 1 year*, as well as travel throughout the Schengen area.
* If the initial application is made from Spanish territory, a 3 year permit will be granted, otherwise it would be 1 year.
** It is possible to apply for the visa before investing the totality of the required amount. In this case, the duration of the permit will be 6 months, having to prove later that the investment has been made.
The duration of the visa can be extended up to 5 years, after which a permanent residence permit can be obtained.
How to apply for the Golden Visa?
First of all, it is important to make sure that you meet the following requirements:
– You cannot be a citizen of the EU, the European Economic Area or Switzerland, or a family member of citizens of these countries.
– Also, you must be of legal age (+18 years old).
– You cannot have entered Spain illegally, nor have stayed illegally or been banned from entering any of the Schengen countries.
– Have public or private health insurance with an insurance company authorized to operate in Spain. It is important to note that travel insurance will not be valid
– No criminal records within the last 5 years.
– On the other hand, you must prove the acquisition of a property in Spain with an investment value equal to or greater than €500,000. The property must be free of charges or encumbrances on that initial €500,000.
